Special contractual terms, known as the EVB-IT, can be used for contracts with the public sector: supplementary contractual terms for the procurement of information technology .
At the BITKOM Open Source Forum on June 24, 2013, SerNet will disclose its EVB-IT contracts and then publish them on the Ser Net website under and continuously update them.
SerNet has been using EVB-IT for many years for contracts with the public sector and also for contracts with industry. For more than 10 years, all service contracts withEVB-IT as general terms and conditions.
Software Subscription - i.e. the subscription for updates of open source software - can be easily and with only a few adjustments (unlike “EVB-IT Maintenance”) contractually regulated with the EVB-IT software license, type A are contractually regulated. Since the end of 2009, SerNet has been using these terms and conditions for the sale of verinice.PRO subscriptions for federal and state authorities, municipalities, broadcasting corporations, etc.
We at SerNet believe it is important that open source software can also be licensed with the simple and well-known contractual frameworks used by public authorities and institutions, and that corresponding services can be provided.
The publication of the contract templates does not include legal advice. Any use for your own purposes is at your own risk. The PDF files are scans without ASCII information on purpose. Hopefully this will encourage reflection when copying or care when using the text recognition :-)
